What decided it

The failure to secure a completed planning obligation to mitigate the likely significant effects on the Epping Forest Special Area of Conservation, which is a matter protected under the first limb of Framework paragraph 11(d) and therefore fatal to the appeal.

The absence of a five-year housing land supply engaged the tilted balance in Framework paragraph 11(d), but the conflict with policies protecting habitats sites (Policies DM2 and DM22) provided a clear reason for refusal, and the social and economic benefits of delivering a small dwelling did not justify a decision otherwise than in accordance with the development plan.
