Main issues, as the Inspector framed them
- Whether conditions 4 and 17 of planning permission BH2024/00507 meet the tests of paragraph 57 of the Framework and the effect of replacing the conditions on the significance of 62 Albion Hill, a non-designated heritage asset
What decided it
The removal of conditions 4 and 17 was justified because they were unreasonable and disproportionate given that structural works require tile removal, and a balanced judgment under NPPF paragraph 216 favoured the considerable weight of securing the building's structural safety, refurbishment and long-term future over the limited harm to heritage significance.
