What decided it
The development would generate a distinct pattern of staff arrivals and departures creating clear potential for overspill parking on Easterly Road and additional vehicular movements in an environment where visibility is already restricted and traffic flow is frequently interrupted, thereby prejudicing highway safety.
The benefits of providing a specialist care home for vulnerable children and efficient use of brownfield land did not outweigh the significant harm to highway safety, and the qualified rights under the Human Rights Act and Public Sector Equality Duty did not override the legitimate planning policy reasons for dismissal.
